Maldives crisis: Emergency decree 'illegal and void', says joint Opposition

The state of emergency decree passed by the Maldivian parliament is illegal, said the Joint Opposition on Tuesday.

The opposition alleged that the Speaker bypassed the constitution to pass the emergency decree in the parliament.

"President Abdulla Yameen failed to muster the required number of votes to pass his emergency legislation. And, so Yameen has ratified and extended the emergency illegally. This state of emergency is illegal and void.

All acts undertaken with emergency powers are illegal. By entirely circumventing the constitution, President Yameen has, in effect, hijacked the entire state and is ruling the Maldives like a military dictator," Parliamentary group leader of the Joint Opposition, Ibrahim Mohamed Solih said.

In a statement, joint Maldivian opposition said, "Article 87b of the constitution stated that 43 MPs (out of 85 MPs) should be present in the parliament during voting on a matter of public compliance. Hence, a state of emergency was a matter of public compliance."

Maldives parliament approves extension of state of emergency by 30 days
Parliament in the Maldives on Tuesday approved a 30-day extension of a state of emergency sought by President Abdulla Yameen who cited an ongoing national security threat and constitutional crisis.
Countries including the United States, India and Canada along with the United Nations have urged Yameen to lift the emergency and restore normalcy.

Tour operators say hundreds of hotel bookings have been cancelled daily since the 15-day emergency was imposed on Feb 5 despite government assurances that all is normal in the resort islands, which are far from the capital.

Yameen imposed the emergency to annul a Supreme Court ruling that quashed the convictions of nine opposition leaders and ordered his government to free those held in prison.
The emergency "shall only apply to those alleged to have carried out illegal activities, it shall not apply to otherwise law abiding residents of, or visitors to, the Maldives," a statement from Yameen's office said on Tuesday.

Emergency in Maldives extended by 30 days as key panel backs Prez Yameen

The state of emergency in the trouble-torn Maldives was today extended by 30 days after the a key parliamentary committee approved President Abdulla Yameen Abdul Gayoom's request, a media report said, allowing him to reinforce his power in the picturesque Indian Ocean island nation.

During an extraordinary meeting of the The National Security Committee of the People's Majlis, approval was given to the Decree for State of Emergency submitted to the People's Majlis (Parliament) by President Yameen, the Sun online reported.

Deputy Speaker of People's Majlis, MP Moosa Manik confirmed the decree was approved by the Committee during its meeting today held behind closed doors.
The Committee approved the decree, and well as the request for a 30-day extension to the State of Emergency, the report said.

The Maldives' Supreme Court late Tuesday revoked its order to release nine political dissidents, including self-exiled former president Mohamed Nasheed.

Amid the ongoing political crisis in the island nation, the Supreme Court on February 1 ordered the immediate release of the nine political leaders and also prohibited the judicial watchdog from probing any case against the top court bench.

The latest development has taken place after President Abdulla Yameen declared a 15-day state of emergency in the country on Monday, giving sweeping powers to security forces in the country, which is reeling under political turmoil under the present dispensation.
