SC collegium to meet today on Justice K M Joseph elevation row: Top updates

The Supreme Court Collegium will meet on Wednesday to discuss Uttarakhand High Court Chief Justice K M Joseph's elevation as a judge of the apex court. Late last month, the Modi government had returned the Collegium's recommendation to elevate Joseph as a Supreme Court judge, saying the proposal was not in accordance with the top court's parameters.

The five-member Collegium, comprising Chief Justice of India (CJI) Dipak Misra and justices J Chelameswar, Ranjan Gogoi, Madan B Lokur, and Kurian Joseph, will discuss threadbare the note sent to the CJI by Law Minister Ravi Shankar Prasad while returning the file related to the recommendation for Justice Joseph's elevation.

According to legal experts, the government will be bound to appoint Justice K M Joseph as a Supreme Court judge if the Collegium reiterates its recommendation. How likely is the Collegium to again recommend his elevation? On February 1, the Collegium had made public its resolution recommending Joseph's name for appointment as an apex court judge, saying he is "more deserving and suitable in all respects" than other chief justices and judges of high courts.
